ICC issues arrest warrant for Putin

The International Criminal Court has issued an arrest warrant for Russian President Vladimir Putin on suspicion of war crimes such as unlawful deportation of children and unlawful transfer of people from the territory of Ukraine to Russia.   • The ICC has no police force and require member nations to enforce its warrants. However, member nations have been reluctant to enforce ICC warrants especially on national leaders or top government officials due to potential diplomatic issues and escalation in conflict.

  • Russia and the US both withdrew from the Rome Statute, which is the jurisdiction of the ICC. But Ukraine has recognized the ICC and allowed it to operate within its borders since 2013. Nearly all of Europe is part of the Rome Statute, aside from Belarus. So Putin would risk arrest if he tried to go to places like France, Germany, Japan, Brazil, UK, places he's had diplomatic visits multiple times in the past decade.

  • It is one thing to issue the warrant. It is another thing entirely to actually arrest him, bring him to trial, convict him and punish him. The life expectancy of the person trying to serve the warrant is probably less than one minute.

  • The idea of " War Crime " is a paradoxical one, in some way it legitimizes armed conflict by implying sometimes War is necessary.

  • It's worse than US just not recognising the ICC, the hauge invasion act of 2002, states that US will take military action against the ICC if they try to charge any US personal or any of the allies. When the ICC announced that they were investigating war crimes in Afghanistan, the US issued arrest warrants for judges connected to the ICC. The 2002 act also states that the US must not supply military aid to any nation that does support the ICC, so US law is being broken by supporting Ukraine as well as any NATO member.

If you think the ICC will have any immediate and meaningful effect on how Putin runs his country or the war, I suggest you are incorrect. It may APPEAR to be an impotent act. My point is that the true power of the World Court is its impact on international policy (the transactional relationship with other nations), and historical records (think about the very long term impact of the Nuremberg trials on Germany as government and people…beyond policy). Putin gives a rat’s ass about the west; inability to personally travel there is at best a minor inconvenience to him personally. He has no goal beyond the grave. The indictment will not not change his behaviour in Ukraine or at home. It will not substantially alter the relationship between Russia and it’s sympathisers (China, North Korea, Iran, etc.). It will, however, coalesce the west under a new doctrine that will isolate Russia as a rogue state, beyond Putin’s criminal exploits. It will generate collective economic and diplomatic policies that will exert profound pressure on the Russian people and government to address the “Putin problem” themselves.

    • That's the thing! They're not. This arrest warrant is nothing but symbolic. Since countries like USA, China, India and Russia don't recognize ICC. USA in particular has a policy of taking any actions it deems necessary if a service man is judged by ICC. This includes military actions. The policy is called 'American Service Man Protection Act' preventing ICC from prosecuting American war criminals.

  • "NATO's expansion forced this war from Russia's hand." is an argument you hear sometimes. But here's the thing: Russia could've chosen to instead increase local cooperation and increased friendliness with the Baltics, with Poland, with Ukraine, with Georgia. But it didn't, because the idea of a mutual, multilateral cooperation instead of simply Russia returning to its historical position as regional top dog telling its satellites what to do was antithetical to Putin's power base.

  • Humans enjoy stuff animals don't or can't enjoy, like inner fulfillment. Due to this awesome feeling being spontaneous to the human nature, we inadvertently recycle it into another spontaneous feature of our nature: assuming our understanding is the one of everybody else, to the point of if it isn't ours will prevail for us... even fighting for it. Human justice seldom getting to deeply enough change someone's behaviour also tells we can seldom listen to what others say about us and give them a chance of having seen stuff in our behaviour that we didn't realize jeopardize others' wellbeing. Maybe because we're all endowed with seriously addicting inner fulfillment, in no way we would jeopardize misusing it.
