So I will say they make decent stuff, but Lume is much better. I tried Native and their stuff burned the hell out of my skin in my arm pits.
Man this is just too perfect! The fact that you are now allowed to, but wont even give her the credit of representing her with the build and supporting shelby is the biggest deserved middle finger i have ever seen
@USRNME UNKNWN86 Almost. What I meant was, according to the court, you CAN build a, let’s call it “Tribute” Eleanor. And they can do nothing to stop you. But you would be I’ll advised to write a story, book, or movie script that had a Ford Mustang named Eleanor in it. Because the holder(s) of the Gone in 60 Seconds literary rights could possibly seek actions against you.
@GrayRaceCat Build one and call it Ellanor instead. It stated the car is not a character. so i dunno how they could copywrite the name eleanor in the context of a movie character at all.

You should be able to take them back to court and sue them for everything they cost you, since there is now precedent set by a higher court. Good on Shelby for slapping Denice down. (Also, she DEFINITELY did not create or design that car)
That's not how a settlement works. And anyway, all this shows is why you shouldn't give in to over-reaching beeeeyatches and make them prove their case in court when you know you're in the right. Unfortunately, not everyone has the money for legal fees to do that, which is what those sociopaths count on, and what's wrong with our legal system. Chris should have filed an anti-SLAPP counter-suit.
She didn't create or design either of the cars. She is living off of other people's dreams and name.
I think Donut did a pretty good job explaining the situation with Halicki's business model, being a "license troll" firm, they obtained the license for the character of "Elanor" from the movie and then went around with the accuracy of a blindfolded skeet shooter trying to sue anyone with a silver Mustang with black racing stripes. Your theory is not far off and I hope to see more from your shop in the future.
I'm checking out your vids due to Legal Eagles vid covering your problems with all this. Da** shame that lawyers have to enable awful people who are willing to ruin cool things for profit. More power to you, and I look forward to checking out all of your builds.

Shelby had drive. When he was looking for funding for the original Cobra cars, he had only built one (1) car. Before each event he would repaint it so people thought they were already being produced. DRIVE!
As a Shelby fan myself, I respect his admiration for Shelby's legacy.

Its so unfortunate that the Halicki team has spent years going out of their way to really destroy people's love for Eleanor. I always wanted one ever since I first saw the 2000 film. And I genuinely believe the vast majority of people just wanted to have a piece of that iconic Shelby Mustang history. I'm glad the right side came out on top on this and justice was eventually served. Although, it NEVER should've reached that point. Congrats for the win.

@W Bass Her company actually owns the Foose Eleanor designs, they hired him, bought and payed for the designs. In my opinion, Foose has had a few hits, but for the most part, I think he is overrated. (Donning my firesuit now!)
I thought the same thing, in OG Gone in 60 second 73 Mustang Mach 1 was and is the only Eleanor
@Adierit That's not even the most ridiculous part of it: Halicki is the rights holder to the *original* Gone in 60 Seconds, in which "Eleanor" is a yellow with single wide black stripe 1973 Ford Mustang Mach 1. The only thing it has in common with the design we more widely know as "Eleanor" is... being a Mustang.

The difference now is you can cite precedent, which is 99% of what the court follows. When the judge asks if the character is copyrightable, you can say "no, your honor, per this other case Shelby vs Halikki it was found lacking standing" also 4 movies? so three where Eleanor was a yellow 73 Mustang, and ONE where it was a silver 67.
@Brian Mclean it's "brand protection" by licensing certain people to build official replicas you ensure that each example meets a minimum standard. do i agree with it NO but thats the idea. also certain vehicles can qualify for copyright protection for example the time machine delorian. THE BATMOBILE. vehicles that have a destinct and definable look and crucial role in their respective media.

I just love to see the build process and appreciate what you guys do but if you would have showed me a picture of those cars I would have said those are a Shelby Mustang. The original film “Gone in Sixty Seconds” did feature an Eleanor, as a 71/73 Mustang Mach 1. That Eleanor was even credited like any other character and actor in a film.

I was pissed off when I heard your project was being litigated because I was very much looking forward to seeing your version of the car. Carol Shelby was the designer of the base for the Halicki car and that's why it seemed odd that she could claim ownership of the vehicle as a movie character. I am glad you will be redoing the project and I am impressed with your attitude about the whole deal after being ripped off by an overzealous legal team.

This turned out great. I started watching your channel only because I was really interested how you will get those two married into a functional, nice, daily driver. I was surprised that it suddenly disappeared and the whole lawsuit felt stinky. I'm glad it turned out this way, people should just forget about Eleanor name and leave it to one good movie, Shelby is the king here and he's the one to pay tribute to. Eleanor proved that they don't deserve any attention, they are just for money.
I heard about this, pretty awesome, halicki and her team have been known trolls over this and I was elated when I heard Shelby gave her the legal smackdown and derailed her gravy train for good.
LegalEagle brought me here... Especially the scene at 21:21 to 22:00. All I gotta say about what you said about Carroll Shelby are 2 words: FACTS & RESPECT! Shelby's both an icon & a hero in the American Car Culture. He created the GT40 for heaven's sake. The Ford GT lineup wouldn't existed today in not for the GT40.

Perhaps the wife was trying to honor his memory, but “in my opinion” she and her team, did the opposite.

Shelby has put his talents into many different vehicles and not all were fords. I think that a tribute car built to honor him is an awesome ending to this story.
Two thoughts: - My wife and I were talking about your car and what happened just a few nights ago while watching a F&F movie. I'm so glad this nightmare is behind you and that you can now tell your story and build what you want. - Also, Classic Recreations makes amazing stuff and I love what they do. Classic Mustang looks with modern guts. I'll likely never be able to afford one, but I'm sure happy for those who are able to buy them and help keep the business going.

Like the vid and think the whole body swap process is sad thing to do to an old car but at the same time also a great thing to make it have all today's comforts I guess I'm always torn on these things but I can see both sides. However Carroll Shelby wasn't a stranger to "Trying it on" either, especially in his later life from what I got from the media and heard. Something to do with a hundred Shelby 427 bodies suddenly being found???

It's funny how people can be doing so well in life and then they just keep wanting more and more and it's never enough so they start going after what they probably consider the little guys, honestly I think having thousands of people building replica cars from your movie is a verry good thing and just brings more attention to the movie and everyone involved. The Eleanor car was always my favorite movie car and like pretty much everyone who has seen the movie I always wanted one. Not anymore I wouldn't want to do anything that could help bring any attention to anything she's involved in.

i Always thought the Elenore car was awesome too till that whole deal went down and they took the car.. I dont think of the car the same anymore.. but hearing this story and the tribute car idea,, that is awesome and im glad you pointed out where the credit was actually due.. Denise almost single handedly destroyed the ambition and dreams for my entire generation of car lovers. I remember in high school writing whole book reports dedicated to Elanor, and every car guy I know loved that car too...and then they pulled all these lawsuits and overnight I and everyone else I know suddenly hated it. I'm so happy the courts got this right in an almost timely manner. The car I used to fall asleep dreaming about isn't gone.

Could you imagine if the company who owns the rights to General Lee went after all those builders? That car clearly stands out and was always a 69 dodge charger with 01, so its easy to see. I personally like doing body swaps since its an easy way to get modern options in an old style body, but it sucks thinking some crazy person could come after me if they really wanted to.
